1.0 Introduction
These general terms and conditions of sale govern the sale of products by YAW SRL (hereinafter the ‘Seller’), with its registered office at Via Quarto Sant’Antonio, 48 – 00047 Marino (RM), VAT number and tax code 16789181001, to any person or entity making a purchase (hereinafter the ‘Buyer’).
For the purposes of these terms and conditions, the Buyer may be:

‘Consumer’, meaning a natural person who purchases for purposes unrelated to any business, commercial, craft or professional activity they may carry out;

‘Professional’, meaning a natural or legal person acting in the course of their business or professional activity.
These terms and conditions apply to all sales made through the channels indicated in this document.
2.0 Sales model
The Seller markets its products exclusively through the official website ugateshop.it.
Access to the website is open to all users, who may register and create a personal account to make purchases.
The Seller reserves the right to suspend or close a user account in the event of a breach of these terms and conditions of sale, misuse of the service or unlawful conduct, following an assessment of the individual case.
The Seller also reserves the right to refuse or limit the fulfilment of orders in the event of abusive conduct, unusual requests or misuse of the services offered.
In the event of problems relating to shipping, delivery or purchased products, the Buyer is invited to contact the Seller first, to enable the request to be handled quickly and effectively.
In the event of payment disputes, the Buyer is invited to contact the Seller first. Opening disputes through payment networks without prior contact may result in the temporary suspension of the account until the dispute is resolved.
3.0 Payments
The Seller provides various payment methods for purchasing products. Any additional costs arising from fees charged by payment service providers will be clearly indicated during the purchase process.
The accepted payment methods are:

Electronic payment systems operated by third-party providers (including Stripe and MultiSafepay), which allow the use of various payment instruments available at checkout

Advance bank transfer
Payments are made through secure external platforms that use encryption protocols to protect the Buyer’s data. The Seller has no access to sensitive data relating to payment instruments.
In the case of payment by bank transfer, processing of the order will begin only after the amount has actually been credited. If payment is not received within a reasonable period, the Seller reserves the right to cancel the order.
The Seller reserves the right to cancel orders arising from obvious errors in the price, availability or description of the product, refunding any amounts paid.
4.0 Right of withdrawal
For purchases made through the website ugateshop.it, the Consumer Buyer has the right to withdraw from the contract within 14 calendar days from the day on which they received the goods, pursuant to Italian Legislative Decree 206/2005.
The date of receipt is the date shown in the carrier’s tracking system.
To exercise the right of withdrawal, the Buyer must communicate their decision by means of an explicit statement, preferably through the page: https://ugateshop.it/it/content/24-invio-richiesta
The request will be reviewed and the operational procedures will be communicated.
The Buyer must return the products within 14 days.
If the return is approved, a PDF form will be sent, which must be printed and placed inside the parcel. If the form is missing, processing of the return will be suspended until the necessary information is received.
If this information is not provided within 90 days, the Seller may dispose of the goods without any obligation to refund.
The products must be intact, unused and complete. The Buyer is responsible for any diminished value.
Returns of damaged products or products that cannot be resold are not accepted.
Shipments requiring collection from lockers, collection points or any method requiring action by the Seller will not be accepted.
The return shipment must be trackable.
The refund will be made within 14 days of notification of withdrawal, with possible suspension until the product has been received and checked.
Return handling operations may take up to 30 days from receipt.
The refund will be made using the same payment method. For a bank transfer, the Buyer must provide an IBAN.
Standard shipping costs are refunded. Return costs remain payable by the Buyer.
The right of withdrawal does not apply to Professionals.
5.0 Processing of personal data
Personal data are processed in accordance with Regulation (EU) 2016/679.
Data controller: YAW SRL.
Purposes: order management, legal obligations, assistance, fraud prevention.
Legal basis: contract, legal obligations, legitimate interest.
Data may be disclosed to carriers, payment providers and advisers.
Data are not publicly disseminated.
The Buyer may exercise the rights provided for by the GDPR by contacting info@yawsrl.it.
6.0 Warranty
Products are covered by a 24-month statutory warranty of conformity for Consumers.
The Seller is liable for any lack of conformity existing at the time of delivery.
The Buyer must provide a detailed description of the defect and technical documentation.
The Seller reserves the right to carry out technical checks and not to proceed with replacement or repair until the checks have been completed.
Damage resulting from improper use, incorrect installation, external agents or tampering is not covered.
If the product is found to conform, a contribution of €20 towards inspection and shipping may be requested.
The Seller does not provide personalised technical advice. Any guidance is for information purposes.
6.2 Spare parts
Spare parts are components intended to be installed in other systems.
Correct installation and technical documentation are required in the event of a warranty claim.
The Seller may request additional information and will not proceed with replacement until the checks have been completed.
Defects resulting from incorrect installation, incompatibility or improper use are excluded.
7.0 Shipping
Shipments are made through selected carriers.
The times indicated are estimates and are not binding.
Product availability is subject to change.
The Seller is not liable for delays caused by suppliers, carriers or force majeure.
Once the goods have been dispatched, transport is the responsibility of the carrier.
8.0 Shipping costs
Costs are calculated at checkout.
They may vary according to weight, volume and destination.
Surcharges may be required for hard-to-reach areas.
In such cases, the customer may accept or cancel the order with a refund.
9.0 Intellectual property
Trademarks and content belong to their respective owners.
Reproduction without authorisation is prohibited.
Any reports will be checked and handled.
