1.0 Introduction

This document regulates the conditions of sale between the YAW SRL (hereinafter referred to as the Shop) and the natural or legal person who purchases the goods (hereinafter referred to as the Buyer).
The company YAW SRL has its registered office in Via Quarto Sant'Antonio, 48 00047 MARINO (RM) - PI e CF 16789181001.

2.0 Sales Model
Our Store sells online exclusively through the websites linked to it and the authorized marketplaces listed below. In particular, the Store can be accessed from the following addresses:

  • ugateshop.it/it

  • ebay

  • manomano

Anyone can register and become a Buyer, but we reserve the right to remove registrations from customers who do not comply with the terms of sale or behave in such a way as to pose a danger to the Store or other Buyers. Removal may be permanent or temporary at our sole discretion and without prior notice from us.

In the event of a problem either in shipping, delivery or in relation to the products purchased, the complaint should always be sent to us first, so that we can provide us with the opportunity to resolve the Buyer's problem quickly. The ability to submit official complaints through marketplace or payment platforms makes it more difficult to resolve the issue quickly.


3.0 Payments

Several payment methods are accepted. Some forms may have an additional cost due to fees imposed by our partners. The payment methods accepted in our Store are:

  • Credit Card (through PayPal or HiPay service)
  • PayPal Account
  • Advance bank transfer

The Credit Card and PayPal methods both take place on the www.paypal.it website or through the stripe platform and take place in a secure and encrypted connection. This is the best way, since the outcome of the transaction is immediately defined and our system automatically starts working on the file immediately.

For marketplace orders, payments are managed by proprietary platforms depending on the technology used on each market.


4.0 Returns and Returns

In the case of partial shipment of the products received, the amount of the refund will be related only to the returned goods.
Packaging, packaging or items that have been used or are not in their original condition will not be accepted. Before shipping, the Buyer must wait for the Store to accept the withdrawal request. The request must be made through our website, by logging into your account and requesting the return from the orders page.

Once the authorization has been received, the customer has 14 (solar) days to send the goods, in this case the date of dispatch will be detected by the courier's track placed on the boxes.

Shipping must be made through a traceable means.

Once the item(s) have reached us and we have checked the condition of the goods, if they meet the standards mentioned above, we will reimburse the Buyer within 30 days for the total amount of their purchase, including the initial shipping costs.
ATTENTION: as established by the European Court of Justice, the expenses that the Buyer will incur to return the goods will not be reimbursed.

4.1 When purchasing via EBAY

As established by Ebay's rules, the Buyer has 30 (calendar) days from receipt of the goods to exercise his right of withdrawal. The delivery date communicated to us by the courier is used as receipt. Please note that this right, which is expressly enshrined in ebay policies, also states that the goods must be returned in the same condition in which they were received. Therefore, the packaging must be intact and the goods must be resaleable (not worn, dirty or in such a condition that it is impossible to sell them as a new item). The right of withdrawal provides a way for the customer to have a change of mind after purchasing and does not enter in any way into the discussions on warranty and replacement, which are dealt with in the specific paragraph.

5.0 Privacy

Those who order through this website accept and read the following mandatory information: the data collected at the time of ordering will be used only to provide the service and/or supply the products purchased and to comply with regulatory, managerial, operational and accounting obligations. We inform you that, pursuant to Legislative Decree 196/2003, containing provisions for the protection of persons and other subjects with respect to the processing of personal data, YAW srl is the data controller of the personal data provided by you, or otherwise acquired in the course of our business.

The processing of personal data means their collection, recording, organization, storage, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, dissemination, erasure and destruction, or the combination of two or more of these operations.

The data you provide will be processed for the following purposes:

  • to provide the service and/or provide the products you have purchased;
  • in relation to contractual, pre-contractual or legal obligations, exclusively for administrative and accounting purposes;
  • to execute the transaction you are making;
  • to comply with legal obligations;
  • for operational, regulatory, fiscal and management needs;

The data will not be communicated to other parties, with the exception of the shipper in charge of delivering the goods, nor will they be disclosed to third parties.

The following data will be collected:

  • the user's first and last name;
  • the user's address;
  • personal e-mail address;
  • phone number;
  • Tax code and VAT number (only if invoice required, and in any case if company or freelancer)

The requested data are necessary, and in the absence of even one of them, it will not be possible to proceed with the supply of the goods or the provision of the service, as we will not be able to fulfill pre-contractual, contractual, regulatory and tax obligations.

The processing of data will be carried out using suitable tools to guarantee its security and confidentiality and may also be carried out through paper and/or automated tools suitable for storing, managing and transmitting the data.

We also inform you that art. 13 of Legislative Decree 196/2003, gives citizens the exercise of specific rights. In particular, the interested party may obtain from the Data Controller the existence or otherwise of his/her personal data, and that such data be made available to him/her in an intelligible form. The interested party may also request to know the origin of the data as well as the logic on which the processing is based; to obtain the cancellation, transformation, or blocking of data processed in violation of the law as well as the updating, rectification, or, if interested, integration of the data; to object, for legitimate reasons, to the processing itself.

6.0 Warranty

As a general premise to all the warranty conditions explained below, we would like to clarify that the warranty always and in any case covers manufacturing or handling defects prior to sale. Therefore, in general, the warranty does not cover damage or tampering caused directly or indirectly by the user or installer as a result of use or installation. The authorization or not of the replacement/repair under warranty is established by our technical staff, to facilitate this task you may be required photographic documentation of the faulty product.

6.1 Finished Products (STANDARD 24 MONTH WARRANTY)

Unless otherwise indicated, all products (not spare parts whose warranty conditions are explained in another paragraph) for sale in the Store have a warranty period of 24 months from the time of sale. The time count starts from the date shown on the tax document. The warranty conditions are those established by the manufacturers of the goods themselves. For the sake of clarity, the following are some conditions in which the product cannot be replaced under warranty:

  • Item tampered with or not properly stored
  • Object with ruined casing condition
  • electronic boards clearly exposed to moisture, water, solvents or other agents that can induce even irreversible malfunctions
  • items not accompanied by appropriate documentation certifying the purchase at our Store (commercial invoice)
  •  Items with damage caused by unqualified personnel
  • Items not used properly
  • Items with depleted batteries

In the event that the Purchaser wishes to initiate a procedure for a warranty replacement, he must use the following method described below:

Contact our warranty service at this info@ugateshop.it address or through the contact form, indicating your first and last name, the date of purchase. At this point, the Store will send you a code to be affixed to the box and the Buyer can send the goods at their own expense, which will then be sent back under warranty.

IMPORTANT: Shipments will not be accepted that do not clearly display our authorization number.

WARNING: Buyer's dispatch of merchandise or pick-up of merchandise by the Store does not indicate that warranty replacement will apply. Only when the goods are available to our technical staff and are checked will we be able to determine whether it is a warranty replacement or not. In the event that the warranty replacement is not accepted, a document will be sent to the Buyer explaining the reasons why the warranty replacement cannot be carried out and the Buyer can decide whether to have the goods back in the condition in which he sent them or to purchase a new one. Both of these last two options are paid for by the Buyer.

If the product sent is found to be in working order, the customer will have to pay the shipping costs for the reshipment of the goods and a flat rate for checking. The total cost amounts to € 20.00, regardless of the price of the product.

6.2 Spare parts (24 MONTHS SPARE PARTS WARRANTY)

Spare parts are considered all those products (both mechanical and electrical components) that cannot function if not properly inserted inside a product and therefore must be considered components of the same.

Spare parts also have a 24-month sales warranty, but since they cannot operate independently and must be assembled together with other components, this assembly must be carried out in a workmanlike manner by competent personnel. In order to be able to authorize or not a warranty on a spare part, our technical staff will need to verify the correct use of the spare part, talking to the person who took care of the repair and use of the product.

No warranty replacement or repair will be authorized if the person who used the product does not provide adequate explanations to our technical personnel.

Special cases in which the warranty will not be considered valid are:

  • Incorrect mechanical assembly of the product (such as to cause extremely rapid wear of the same).
  • Wrong electrical connection.
  • Carelessness in the mechanical closure such as to allow water or moisture to penetrate.
  • Use of the wrong and inadequate spare part.
  • Use of the spare part or component for a use other than its creation.
  • Changes made by the user to the operation of the product, if these have not been suggested by the manufacturer.


6.3 Warranty Replacement/Repair Waiting Times by Manufacturer

Our company markets products from different manufacturers and that apply different warranty times and policies. Below is a generic diagram depending on the category and manufacturer on warranty times. It should also be noted that the manufacturer's warranty time is in no way linked to the method of providing the warranty, for which reference must always be made to art. 6.1 and 6.2 of these T&Cs. The buyer is free to contact the manufacturer directly to ask if he can directly benefit from the manufacturer's warranty.

We also specify some exceptions to Articles 6.1 and 6.2 in line with the indications provided by the manufacturers.

Product Warranty BFT: establishes a standard warranty of 24 months on all finished products, so the warranty conditions in paragraph 6.1 are applicable in full and for spare parts the conditions in paragraph 6.2.

Product Warranty FAAC: establishes a standard warranty of 24 months on all finished products, so the warranty conditions in paragraph 6.1 are applicable in full and for spare parts the conditions in paragraph 6.2.

Product Warranty NICE: establishes a warranty period of 24 months, with the particularity that electronic products (boards, control units, receivers and remote controls) must be sent directly to the service center to evaluate the actual possibility of applying the warranty. This makes the eventual replacement and return of the goods slower than the normal procedure.

Product Warranty GIBIDI: establishes a standard warranty of 24 months on all finished products, so the warranty conditions in paragraph 6.1 are applicable in full and for spare parts the conditions in paragraph 6.2.

Product Warranty PROTECO: establishes a standard warranty of 24 months except for some products for which an extension to 36 months is provided, this indication can be found on the photographs of the products on our site. On all finished products, therefore, the warranty conditions in paragraph 6.1 are fully applicable and for spare parts the conditions in paragraph 6.2.

Product Warranty STAFER: establishes a standard warranty of 24 months on all finished products except V6 series, V6M tubular motors without on-board electronics, for which a warranty period of 120 months (10 years) is established, so the warranty conditions in paragraph 6.1 are applicable in full and for spare parts the conditions in paragraph 6.2.

Product Warranty ABEXO: establishes a standard warranty of 24 months on all finished products, so the warranty conditions in paragraph 6.1 are applicable in full and for spare parts the conditions in paragraph 6.2.

Product Warranty YAW: establishes a standard warranty of 24 months on all finished products, so the warranty conditions in paragraph 6.1 are applicable in full and for spare parts the conditions in paragraph 6.2.


7.0 Shipping (from the ugateshop.it website)

The most important part of our job is to try to satisfy the visitor of our site by trying to make him become a customer and providing him with the most detailed information possible related to exclusive services that he can only find in our e-store. On the product page and on the shopping cart page, useful information is available to better evaluate the purchase. In particular, the following are indicated: the availability of the product and its maximum waiting time from the order (in the event that the product is unavailable).

The availability of our products varies continuously based on the daily purchases that take place on the site, which is why we have different levels of timing (availability is updated every day.


7.1 Shipping (through EBAY - MANOMANO markets)

Shipments of products sold through the platforms follow the normal shipping process.

Shipping time may vary depending on several factors, such as availability, country of destination, size of the product. Large-volume, heavy-weight shipments require more handling time.

What can also affect the shipping time is the flow of orders, which at certain times of the year is very high and slows down our logistics organization.

For each shipment, the track is transmitted to the marketplace and then the customer can follow the shipment through their account.


8.0 Shipping cost

The cost of shipping varies depending on many factors, our algorithm always averages the cost of shipping by proposing the best one (if you buy on our ugateshop.it platform)

If you are buying through marketplaces (EBAY, MANOMANO), the cost of shipping varies by product and is displayed directly in the marketplace.

It can rarely happen that some area is considered disadvantaged. This is because it is normally located in a geographically difficult place (La Maddalena, Venice lagoon, Campione d'Italia, Procida. Ischia, etc.). In these rare cases, couriers charge surcharges. Since there is no way to know in advance whether an area is disadvantaged or not, in the event that an order has to be shipped to such areas we will warn the customer that there is a surcharge. If the customer agrees to pay the difference we will ship, otherwise we will cancel the order and proceed with a refund if the customer has paid in advance.

We are perfectly aware that shipping costs are often an obstacle to buying online, which is why we are constantly working to ensure that the prices of our products, added to the cost of shipping, are within market parameters.


9.0 Ownership of Trademarks

All trademarks on our site and on the products published are the property of their respective owners.

The photographs of the products are taken by us directly, where it was not possible to make them we took free photos on the web. Under no circumstances, if at all, have we willfully infringed the copyrights of their respective owners.
