GENERAL TERMS AND CONDITIONS OF SALE
1.0 Introduction
These general terms and conditions govern the sale of products by YAW SRL (hereinafter referred to as the “Seller”), with registered office at Via Quarto Sant’Antonio, 48 – 00047 Marino (RM), VAT and Tax Code 16789181001, to any person purchasing products (hereinafter referred to as the “Buyer”).
For the purposes of these terms, the Buyer may be:

a “Consumer”, meaning a natural person acting for purposes outside their trade, business or profession;

a “Professional”, meaning a natural or legal person acting in the course of their business or professional activity.
These conditions apply to all sales made through the channels indicated in this document.
2.0 Sales Model
The Seller sells its products exclusively through the official website ugateshop.it.
Access to the website is allowed to all users, who may register and create a personal account to place orders.
The Seller reserves the right to suspend or close a user account in case of violation of these conditions, improper use of the service, or unlawful behavior, subject to case-by-case evaluation.
The Seller also reserves the right to refuse or limit order processing in case of abusive behavior, anomalous requests, or improper use of services.
In case of issues related to shipping, delivery, or purchased products, the Buyer is invited to contact the Seller first in order to allow a fast and effective resolution.
In case of payment disputes, the Buyer is invited to contact the Seller first. Opening disputes through payment providers without prior contact may result in temporary suspension of the account until resolution.
3.0 Payments
The Seller provides several payment methods. Any additional costs due to payment service provider fees will be clearly indicated during checkout.
Accepted payment methods include:

Electronic payment systems managed by third-party providers (including Stripe and MultiSafepay), allowing various payment methods available at checkout

Bank transfer in advance
Payments are processed through secure external platforms using encryption protocols. The Seller does not have access to sensitive payment data.
For bank transfers, the order will be processed only after the funds are received. If payment is not received within a reasonable time, the Seller reserves the right to cancel the order.
The Seller reserves the right to cancel orders resulting from obvious pricing, availability, or product description errors, issuing a refund if necessary.
4.0 Right of Withdrawal
For purchases made on ugateshop.it, the Consumer Buyer has the right to withdraw from the contract within 14 calendar days from receipt of the goods, pursuant to Legislative Decree 206/2005.
The delivery date is based on the courier tracking system.
To exercise the right of withdrawal, the Buyer must submit a clear request, preferably through:

The request will be reviewed and further instructions will be provided.
The Buyer must return the goods within 14 days.
If the return is approved, a PDF form will be sent and must be printed and included in the package. Missing forms will suspend processing until completed.
If required information is not provided within 90 days, the Seller may dispose of the goods without refund.
Products must be intact, unused, and complete. The Buyer is responsible for any loss in value.
Returns of damaged or non-resalable products will not be accepted.
Returns requiring collection from lockers or pickup points will not be accepted.
Returns must be shipped with tracking.
Refunds will be made within 14 days from withdrawal notification, but may be suspended until goods are received and verified.
Processing may take up to 30 days from receipt.
Refunds will be issued using the original payment method. For bank transfers, the Buyer must provide IBAN details.
Standard shipping costs will be refunded. Return shipping costs are borne by the Buyer.
The right of withdrawal does not apply to Professionals.
5.0 Personal Data Processing
Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR).
Data Controller: YAW SRL.
Purpose: order management, legal obligations, customer support, fraud prevention.
Legal basis: contract execution, legal obligations, legitimate interest.
Data may be shared with couriers, payment providers, and consultants.
Data will not be publicly disclosed.
The Buyer may exercise their rights by contacting info@yawsrl.it.
6.0 Warranty
Products are covered by a 24-month legal warranty of conformity for Consumers.
The Seller is responsible for defects existing at the time of delivery.
The Buyer must provide a detailed description of the defect and supporting documentation.
The Seller reserves the right to perform technical verification and may withhold repair or replacement until verification is completed.
Warranty excludes damage caused by improper use, incorrect installation, external factors, or tampering.
If no defect is found, a €20 fee for inspection and return shipping may be charged.
The Seller does not provide technical consultancy. Any guidance is for informational purposes only.
6.2 Spare Parts
Spare parts are components intended to be installed within other systems.
Proper installation and technical documentation are required for warranty claims.
The Seller may request additional information and will not proceed with replacement until verification is complete.
Warranty excludes issues caused by incorrect installation, incompatibility, or improper use.
7.0 Shipping
Shipping is carried out via selected couriers.
Delivery times are estimates and not binding.
Product availability may vary.
The Seller is not responsible for delays caused by suppliers, couriers, or force majeure.
Once shipped, delivery is under the responsibility of the courier.
8.0 Shipping Costs
Shipping costs are calculated at checkout.
They may vary based on weight, volume, and destination.
Additional costs may apply for remote areas.
In such cases, the Buyer may accept the extra cost or cancel the order with a full refund.
9.0 Intellectual Property
All trademarks and content belong to their respective owners.
Reproduction without authorization is prohibited.
Any infringement claims will be reviewed and handled accordingly.
